Statements and opinions reflected in content within Brown on iTunes U are those of the author, and are not endorsed by Brown University. In addition, Brown University forbids posting third-party copyrighted materials to Brown on iTunes U unless written authorization from the author permitting this exact use is provided. Brown University does not permit copyright infringing activities and infringement of intellectual property rights on its public iTunes site. Any party asserting that content presented on Brown on iTunes U infringes on the intellectual property rights of others should contact iTunesPublic@Brown.edu.

Inclusion Guidelines
Brown University uses ITunes U to convey information about its teaching, research, outreach, alumni and campus life. Examples of acceptable content include, but are not limited to audio, video or podcasts of lectures, events or seminars, student activities, or animated video. Public Affairs and University Relations (PAUR) and Computing & Information Services co-sponsor Brown on iTunes U. In its sole discretion, PAUR reserves the right to decide which content is appropriate for the public face of Brown on iTunes U and to remove content at any time without prior notice. To report inappropriate content on Brown on iTunes U, or for more information about it, contact iTunesPublic@Brown.edu.

Content Submission Guidelines

To post content on Brown on iTunes U, please read the following instructions and disclosures carefully.

Acceptable Content: Brown on iTunes U accepts only audio and video content. Examples of acceptable content include (but aren't limited to): audio, video, or podcasts of lectures, events or seminars; research findings; faculty, student or staff profiles; student activities audio and video. Public Affairs and University Relations (PAUR) reserves the right to decide which content is appropriate for the public face of Brown on iTunes U and to remove content at any time without prior notice.

Intellectual Property Issues: Although contributors to Brown on iTunes U retain all ownership rights to their Content, to participate in Brown on iTunes U, contributors must grant to Brown University and Apple, Inc. a license to the Content for purposes of use on the iTunes site (including marketing thereof). Uploading Content grants to Brown University and Apple, Inc., a non-exclusive, royalty-free right and license to use, reproduce and modify the format and display (but not the substance) of that Content (including all audio, video, textural, graphical and other material associated therewith), and to distribute, perform, transmit and display the Content on the iTunes U and iTunes Stores worldwide, in whole or in part, by any means now known or hereafter developed (such as, but not limited to, by websites or electronic downloads) for purposes consistent with those described in these Content Submission Guidelines, including marketing of the iTunes U and iTunes Store sites, and the Brown University site thereon.

In addition, to the best of each Contributor's knowledge, Content does not include any falsehoods or misrepresentations, or material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, or encourages conduct that would be considered a criminal offense.

Acceptable Content must be original work. To the extent that Content incorporates any material that others might claim an interest, the Contributor is responsible to obtain all necessary permissions.

Note that material incorporated into teaching, which might constitute "fair use" in the classroom, may not be eligible for that protection in the context of a public posting such as iTunes. If you have any questions or concerns about intellectual property issues associated with your Content or with the posting of your Content on Brown on iTunes U, please contact iTunesPublic@Brown.edu.

By uploading Content, contributors accept responsibility that their Content does not infringe upon others' intellectual property interests. Contributors are also responsible to have made all appropriate attributions. By contributing to Brown on iTunes U, contributors verify that they own the Content and/or have obtained all necessary permissions. Contribution verifies [< asserts?] that Content is the contributor's own original work, does not infringe the intellectual property rights of anyone else, and that contributor has made all appropriate attributions. In particular, the contributor represents that: He/she own or have the necessary licenses, rights, consents, and permissions to use all patent, trademark, trade secret, copyright or other proprietary rights in and to the Content, sufficient to allow inclusion and use of my Content in the iTunes U and iTunes Store sites, and the Brown University site thereon; and (ii) I have obtained written consent, release and/or permission of every identifiable person represented in my Content to use their name and/or likeness to allow inclusion and use of my Content in the iTunes U and iTunes Store sites, and the Brown University site thereon; and (iii) To the best of my knowledge, the Content does not include any falsehoods or misrepresentations, or material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, or encourages conduct that would be considered a criminal offense.

Furthermore, the contributor understands that, Neither Brown University nor iTunes U guarantees confidentiality of any Content that I submit, and that any Content published on Brown on iTunes U will be publicly available (and not password protected or otherwise considered private or limited-access); and (ii) I am solely responsible for the consequences of publishing the Content that I submit (including any monitoring of the use or downloading of such Content); I acknowledge that public posting of my Content on iTunes carries the risk of misappropriation or infringement by third parties.

Obtaining Permissions: In the event that content includes pictures or video / audio recording of students or any other third party, contributor may need to obtain written permission from them in advance of posting content to Brown on iTunes U. Contributors are responsible to maintain all obtained permissions in their records. Please contact iTunesPublic@Brown.edu if you have questions or need assistance.

Understanding iTunes U Site and Model: Brown University encourages all content submitters to review the iTunes U site and to become familiar with its operation and presentation formats. Content presented on Brown on iTunes U will be available to the public via Internet access. The iTunes U model allows for Apple, Inc. to modify the look and function, but not substance, of any Content posted on Brown on iTunes U. Apple may also make changes so that only a portion of contributor Content is presented. By submitting Content to Brown University for submission, contributor verifies understanding Apple's possible uses of that Content. The contributor also understands that neither Brown University nor Apple is able or responsible to control third-party use of Content posted on Brown on iTunes U.

Preserving Original Work: Although Brown University facilitates posting of Content on the iTunes U site, Brown University will not be responsible to assure that the Content is preserved. Materials presented on Brown on iTunes U are resident on servers not owned or operated by Brown University. Contributor must ensure content is separately preserved on other electronic media.

Confidential and Sensitive Information: Contributor is responsible to assure that Content does not contain any materials or information confidential or sensitive, including personal information of Brown University faculty, staff or students that may be protected by law (e.g., pursuant to FERPA or HIPAA). By submitting Content, contributor acknowledges and agrees to all of the terms and conditions related to submission and posting of Content on Brown on iTunes U as described in these Submission Guidelines.
